ՀԱՅԱՍՏԱՆԻ ՀԱՆՐԱՊԵՏՈՒԹՅՈՒՆԻՑ ԵՎՐՈՊԱԿԱՆ ՄԻՈՒԹՅԱՆ ԵՐԿՐՆԵՐ ՎԱՅՐԻ ՋՐԱՅԻՆ ԿԵՆԴԱՆԻՆԵՐԻ ԱՐՏԱՀԱՆՄԱՆ ՀԱՄԱՐ ՊԱՀԱՆՋՎՈՂ ԱՌՈՂՋՈՒԹՅԱՆ ՍԵՐՏԻՖԻԿԱՏ ՏԱԼՈՒ ԿԱՐԳԸ ԵՎ ՍԵՐՏԻՖԻԿԱՏԻ ՁԵՎԸ ՀԱՍՏԱՏԵԼՈՒ ԵՎ ՀԱՅԱՍՏԱՆԻ ՀԱՆՐԱՊԵՏՈՒԹՅԱՆ ԿԱՌԱՎԱՐՈՒԹՅԱՆ 2010 ԹՎԱԿԱՆԻ ՀՈԿՏԵՄԲԵՐԻ 21-Ի N 1499-Ն ՈՐՈՇՄԱՆ ՄԵՋ ԼՐԱՑՈՒՄ ԿԱՏԱՐԵԼՈՒ ՄԱՍԻՆ
Հայաստանի Հանրապետության կառավարությունը որոշում է.
1. Հաստատել`
1) Հայաստանի Հանրապետությունից Եվրոպական միության երկրներ վայրի ջրային կենդանիների արտահանման համար պահանջվող առողջության սերտիֆիկատ տալու կարգը` համաձայն N 1 հավելվածի.
2) Հայաստանի Հանրապետությունից Եվրոպական միության երկրներ վայրի ջրային կենդանիների արտահանման համար պահանջվող առողջության սերտիֆիկատի ձևը` համաձայն N 2 հավելվածի:

2. Հայաստանի Հանրապետության կառավարության 2010 թվականի հոկտեմբերի 21-ի «Կենդանիների, կենդանական ծագում ունեցող մթերքի, հումքի, կերերի, լրացակերերի, կերային խառնուրդների, կերային հավելումների և սննդամթերքի ներմուծման, արտահանման, հանրապետության տարածքում փոխադրման համար անասնաբուժական ուղեկցող փաստաթղթեր և անվտանգության սերտիֆիկատներ տալու կարգը, անասնաբուժական ուղեկցող փաստաթղթերի ու անվտանգության սերտիֆիկատների ձևերը հաստատելու և Հայաստանի Հանրապետության կառավարության 2005 թվականի օգոստոսի 4-ի N 1241-Ն որոշումն ուժը կորցրած ճանաչելու մասին» N 1499-Ն որոշման N 1 հավելվածը 1-ին կետից հետո լրացնել հետևյալ բովանդակությամբ նոր` 1.1-ին կետով.
«1.1. Սույն կարգի գործողությունը չի տարածվում Հայաստանի Հանրապետությունից Եվրոպական միության երկրներ վայրի ջրային կենդանիների արտահանման համար պահանջվող առողջության սերտիֆիկատ տալու ընթացակարգի վրա:»:
3. Սույն որոշումն ուժի մեջ է մտնում պաշտոնական հրապարակման օրվան հաջորդող տասներորդ օրը:

ՀԱՅԱՍՏԱՆԻ ՀԱՆՐԱՊԵՏՈՒԹՅՈՒՆԻՑ ԵՎՐՈՊԱԿԱՆ ՄԻՈՒԹՅԱՆ ԵՐԿՐՆԵՐ ՎԱՅՐԻ ՋՐԱՅԻՆ ԿԵՆԴԱՆԻՆԵՐԻ ԱՐՏԱՀԱՆՄԱՆ ՀԱՄԱՐ ՊԱՀԱՆՋՎՈՂ ԱՌՈՂՋՈՒԹՅԱՆ ՍԵՐՏԻՖԻԿԱՏ ՏԱԼՈՒ
1. Սույն կարգով սահմանվում է Հայաստանի Հանրապետությունից Եվրոպական միության երկրներ վայրի ջրային կենդանիների արտահանման համար պահանջվող առողջության սերտիֆիկատ (այսուհետ` սերտիֆիկատ) տալու ընթացակարգը:

2. Սերտիֆիկատը Հայաստանի Հանրապետության սննդամթերքի անվտանգության տեսչական մարմնի (այսուհետ` տեսչական մարմին) կողմից տրվում է Եվրոպական միության երկրներ վայրի ջրային կենդանու արտահանման թույլտվություն ստացած տնտեսավարող սուբյեկտներին:
(2-րդ կետը փոփ. 14.01.2021 թիվ 47-Ն որոշում)
3. Սերտիֆիկատը տրվում կամ դրա տրամադրումը մերժվում է սույն կարգի 5-րդ կետով սահմանված` արտահանման համար պահանջվող փաստաթղթերը ներկայացնելուց հետո` մեկ օրվա ընթացքում:

4. Սերտիֆիկատը տրվում է արտահանվող ապրանքի յուրաքանչյուր խմբաքանակի համար` որսի, ցամաք հանելու, փաթեթավորման, վերամշակման, սառեցման, պահպանման, մակնշման, տեղափոխման, շուկայահանման գործընթացներում ներկայացվող սանիտարական պահանջներին համապատասխանության վերաբերյալ տեսչական մարմնի անասնաբուժական տեսչության (այսուհետ` տեսչություն) հսկողության արդյունքների հիման վրա:

5. Սերտիֆիկատ ստանալու համար արտահանող տնտեսավարող սուբյեկտը տեսչական մարմին ներկայացնում է`
1) դիմում` նշելով արտահանվող ապրանքի անվանումը, քաշը, արտահանման երկիրը, իրավաբանական անձի դեպքում` անվանումը, գտնվելու և գործունեության վայրերը, անհատ ձեռնարկատիրոջ դեպքում` անունը, ազգանունը, բնակության և գործունեության վայրերը.
2) տվյալ խմբաքանակի լաբորատոր հետազոտությամբ անվտանգությունը հավաստող փաստաթուղթը` տրված հավատարմագրված լաբորատորիայի կողմից.
3) արտահանման թույլտվության պատճենը` տրված համապատասխան պետական լիազոր մարմնի կողմից.
4) ծագման երկրի հավաստագրի պատճենը` ներմուծող երկրի պահանջի առկայության դեպքում:

6. Սերտիֆիկատ տրվում է, եթե ներկայացվել են սույն կարգի 5-րդ կետով սահմանված փաստաթղթերը և արտահանվող ապրանքի` որսի, ցամաք հանելու, փաթեթավորման, վերամշակման, սառեցման, պահպանման, մակնշման, տեղափոխման, շուկայահանման գործընթացներում ներկայացվող սանիտարական պահանջներին համապատասխանության վերաբերյալ տեսչությունը տվել է դրական եզրակացություն:
7. Առողջության սերտիֆիկատի տրամադրումը մերժվում է, եթե չեն ներկայացվել սույն կարգի 5-րդ կետով սահմանված փաստաթղթերը կամ որսի, ցամաք հանելու, փաթեթավորման, վերամշակման, սառեցման, պահպանման, մակնշման, տեղափոխման, շուկայահանման գործընթացներում ներկայացվող սանիտարական պահանջներին համապատասխանության վերաբերյալ տեսչությունը տվել է բացասական եզրակացություն:
8. Սույն կարգի պահանջների կատարման հետ կապված վեճերը լուծվում են օրենքով սահմանված կարգով:
