ՀԱՄԱՁԱՅՆԱԳԻՐ
ՀԱՅԱՍՏԱՆԻ ՀԱՆՐԱՊԵՏՈՒԹՅԱՆ ԿԱՌԱՎԱՐՈՒԹՅԱՆ ԵՎ ԵԳԻՊՏՈՍԻ ԱՐԱԲԱԿԱՆ ՀԱՆՐԱՊԵՏՈՒԹՅԱՆ ԿԱՌԱՎԱՐՈՒԹՅԱՆ ՄԻՋԵՎ ԴԻՎԱՆԱԳԻՏԱԿԱՆ, ԾԱՌԱՅՈՂԱԿԱՆ ԿԱՄ ՀԱՏՈՒԿ ԱՆՁՆԱԳԻՐ ՈՒՆԵՑՈՂ ԱՆՁԱՆՑ ՄՈՒՏՔԻ ԱՐՏՈՆԱԳԻՐ ՍՏԱՆԱԼՈՒ ՊԱՀԱՆՋԻՑ ԵՐԿԿՈՂՄ ԱԶԱՏՄԱՆ ՄԱՍԻՆ

Հայաստանի Հանրապետության Կառավարությունը և Եգիպտոսի Արաբական Հանրապետության Կառավարությունը (այսուհետ` Կողմեր),

ցանկանալով էլ ավելի զարգացնել բարեկամական հարաբերությունները և համագործակցությունը երկու պետությունների միջև,

ձգտելով դյուրացնել ուղևորության հետ կապված ընթացակարգերը դիվանագիտական, ծառայողական կամ հատուկ անձնագրեր ունեցող անձանց համար,

համաձայնեցին հետևյալի մասին.

ՀՈԴՎԱԾ 1

Յուրաքանչյուր Կողմ ազատում է մյուս Կողմի պետության` վավերական դիվանագիտական, ծառայողական կամ հատուկ անձնագիր ունեցող քաղաքացիներին մուտքի արտոնագիր ստանալու պահանջից` այցելության նպատակով իր տարածք մուտք գործելու կամ մուտք գործելու օրվանից իննսուն (90) օրը չգերազանցող ժամանակահատվածով գտնվելու համար:

ՀՈԴՎԱԾ 2

Պետություններից որևէ մեկում հավատարմագրված դիվանագիտական ներկայացուցչությունների կամ հյուպատոսական հիմնարկների անդամներին, ինչպես նաև նրանց ընտանիքների անդամներին, որոնք ունեն վավերական դիվանագիտական, ծառայողական կամ հատուկ անձնագրեր, թույլատրվում է առանց մուտքի արտոնագրի մուտք գործել մյուս Կողմի պետության տարածք և գտնվել այնտեղ ծառայության ընթացքում:

ՀՈԴՎԱԾ 3

Երկու պետությունների այն քաղաքացիները, որոնք ունեն 1-ին հոդվածում նշված անձնագիր, բացառությամբ 2-րդ հոդվածում նշված քաղաքացիների, որոնք մտադիր են մյուս Կողմի պետության տարածքում գտնվել իննսուն (90) օրից ավելի, պետք է, մյուս Կողմի պետության կանոնակարգերին համապատասխան, ստանան մուտքի արտոնագիր:

ՀՈԴՎԱԾ 4

Դիվանագիտական, ծառայողական կամ հատուկ անձնագիր ունեցող երկու պետությունների քաղաքացիների` մյուս պետության տարածք մուտք գործելը և այդ տարածքից հեռանալը պետք է իրականացվի միջազգային ուղևորափոխադրումների համար թույլատրված` երկու պետությունների սահմանային ցանկացած անցակետից:

ՀՈԴՎԱԾ 5

Սույն Համաձայնագիրը դիվանագիտական, ծառայողական կամ հատուկ անձնագիր ունեցող անձանց չի ազատում մյուս Կողմի տարածքում օրենքներն ու կանոնակարգերը պահպանելու պարտավորությունից:

ՀՈԴՎԱԾ 6

1. Յուրաքանչյուր Կողմ իրեն իրավունք է վերապահում մասնակիորեն կամ ամբողջությամբ դադարեցնելու վերը նշված դրույթների պահպանումը` ելնելով պետության անվտանգության ապահովման, հանրային կարգի, առողջապահության կամ այլ լուրջ նկատառումներից:

2. Այդպիսի դադարեցման մասին դիվանագիտական ուղիներով պետք է անհապաղ ծանուցվի մյուս Կողմը:

ՀՈԴՎԱԾ 7

Երկու Կողմերը դիվանագիտական ուղիներով փոխանակում են իրենց վավերական` ծառայողական կամ հատուկ անձնագրերի երեք նմուշ դրանք գործողության մեջ դնելուց առնվազն տասնհինգ (15) օր առաջ:

ՀՈԴՎԱԾ 8

Սույն Համաձայնագիրն ուժի մեջ է մտնում վերջին գրավոր ծանուցումն ստանալու օրվանից, որով Պայմանավորվող կողմերը միմյանց տեղեկացնում են, որ սույն Համաձայնագիրն ուժի մեջ մտնելու համար պահանջվող իրենց ներպետական իրավական ընթացակարգերը կատարվել են:

Սույն Համաձայնագիրը վավերական է հինգ տարի ժամկետով և ինքնաբերաբար կերկարաձգվի նույն ժամանակահատվածով, եթե Կողմերից որևէ մեկը գրավոր չհայտնի Համաձայնագիրը դադարեցնելու իր ցանկության մասին այն դադարեցնելուց վեց ամիս առաջ:

Կատարված է Կահիրեում 2009 թվականի փետրվարի 24-ին, երկու բնօրինակով, յուրաքանչյուրը` հայերեն, արաբերեն և անգլերեն, ընդ որում, բոլոր տեքստերն էլ հավասարազոր են:

Մեկնաբանման ժամանակ տարաձայնություն առաջանալու դեպքում կգերակայի անգլերեն տեքստը:

Համաձայնագիրն ուժի մեջ է մտել 2010 թ. նոյեմբերի 14-ին

AGREEMENT

Between the Government of the Republic of Armenia and the

Government of the Arab Republic of Egypt on the Mutual Exemptoion

of Visas for Holders of Diplomatic, Service or Special Passports

The Government of the Republic of Armenia and the Government of the Arab Republic of Egypt, hereinafter referred to as the «parties»,

Desiring to further develop friendly relations and cooperation between their two states,

Seeking to facilitate travel procedures for the holders of diplomatic, service or special passports of the two States,

Have agreed as follows:

Article 1

One party shall exempt the nationals of the State of other Party, holders of valid diplomatic, service or special passports, form the obligation to obtain a visa for the purpose of entering its, territory for a visit or stay not exceeding ninety (90) days from the date of entry.

Article 2

The members of diplomatic or consular missions and international organizations accredited to either State as well as the members of their families who are holders of a valid diplomatic, service or Special passports shall be allowed to enter to the territory of the State of the other Party without visa and to stay there during the period of their official mission.

Article 3

Nationals of either State, holding a passport referred to in Article (1) except for the national referred to Article (2), who intend to stay longer than ninety (90) days in the territory of the other State of other party, are required to obtain a stay visa in accordance with the regulation of the other State of other party.

Article 4

The entry and exit of the nationals of both States, holding a diplomatic, service or special passport to and from the territory of the other State have to be accomplished through any border crossing point of the two States authorized for international passenger traffic.

Article 5

This Agreement does not exempt nationals of states the parties, holding a diplomatic, service or special passports from the obligations to respect the laws and regulations in the territory of the other Party.

Article 6

1. Each Party reserves the right to cease the protection of the foregoing provisions in whole or in part, for the reasons of protection of security of state, public order, health protection or other serious reasons.

2. Such ceasing of application shall be notified immediately to the other Party through diplomatic channels.

Article 7

The two parties shall exchange through diplomatic channels three specimens of their valid service or special passports at least fifteen (15) days before their introduction.

Article 8

This Agreement shall enter into force on the date of receipt of the last written notification by which the contracting parties shall inform each that their internal legal procedures for its entry into force have been completed.

This Agreement will be valid for a period of five years and will be extended automatically for the same periods unless either of the Parties expresses its desire to terminate it in a written form six months prior to its Termination.

Done at Cairo, on 24th of February 2009, in two original copies, each of them in the Armenian, Arabic and English languages, all texts are equally authentic.

In the case of any divergence of interpretation, the English text shall prevail.

The Agreement has entered into force on 14.11.2010
